1. Agreement to Terms

By accessing fortune3r.com, subscribing to any plan offered by Fortune 3R LLC, or downloading any content from our platform, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you may not access or use our platform.

These Terms & Conditions apply to all visitors, subscribers, and members of fortune3r.com, including users of the Leading as a Waymaker newsletter and Waymaker Leadership Intelligence Library.

2. Description of Services

Fortune 3R LLC offers the following services through fortune3r.com:

• Leading as a Waymaker — a paid newsletter and leadership intelligence library for leaders, executives, founders, and high-capacity professionals
• Free edition newsletter content accessible via email opt-in
• Paid edition newsletter content and library access via subscription
• Leadership intake forms and consultation inquiry services

Fortune 3R LLC reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice to active subscribers.

3. Subscription Plans and Pricing

Fortune 3R LLC offers three paid subscription tiers for access to the Leading as a Waymaker paid edition and Waymaker Leadership Intelligence Library:

• Founding Member: $9.00 per month — available to the first 50 subscribers only
• Monthly: $17.00 per month — billed monthly, cancel anytime
• Annual: $170.00 per year — billed annually

All prices are listed in United States Dollars (USD) and are subject to applicable taxes depending on your location.

3.1 Founding Member Rate Lock

Subscribers who join as Founding Members at the $9.00 per month rate will retain that rate for as long as their subscription remains active and uninterrupted. If a Founding Member cancels their subscription and later resubscribes, the Founding Member rate will no longer apply and the then-current standard pricing will be used.

3.2 Existing Subscriber Grandfather Rate

Subscribers who joined Fortune 3R LLC prior to the current pricing structure will be grandfathered at their original subscription rate for as long as their subscription remains active and uninterrupted.

3.3 Price Changes

Fortune 3R LLC reserves the right to change subscription pricing at any time. Active subscribers will receive no less than thirty (30) days advance notice of any price change affecting their subscription.

Founding Members and grandfathered subscribers are exempt from standard price changes as described above.

4. Payment and Billing

All payments are processed securely through Kajabi Payments, which operates in connection with Stripe. By providing your payment information, you authorize Fortune 3R LLC to charge your payment method for the subscription plan you select.

• Monthly subscribers are billed on the same date each month from the date of initial subscription
• Annual subscribers are billed once per year on the anniversary of their subscription date
• You are responsible for maintaining accurate and current payment information
• If a payment fails, Fortune 3R LLC reserves the right to suspend access to paid content until payment is successfully processed

5. Cancellation Policy

You may cancel your subscription at any time through your account settings on fortune3r.com. Cancellation takes effect at the end of your current billing period.

• Monthly subscribers who cancel will retain access to paid content through the end of their current monthly billing period
• Annual subscribers who cancel will retain access to paid content through the end of their current annual billing period
• Fortune 3R LLC does not offer refunds on subscription fees, including partial period refunds
• Cancellation does not entitle the subscriber to a refund of any fees already paid

6. Refund Policy

All subscription fees are non-refundable. Fortune 3R LLC does not offer refunds, credits, or pro-rated amounts for partial subscription periods, unused access, or early cancellation. By subscribing, you acknowledge and agree to this no-refund policy.

If you believe you have been charged in error, please contact [email protected] within seven (7) days of the charge and we will review your case.

7. Intellectual Property and Content Protection

All content published by Fortune 3R LLC — including but not limited to the Leading as a Waymaker newsletter issues, the Waymaker Identity Method, the Waymaker Transformation Sequence, the 4A Transformer framework, all composite leader stories, all written copy, PDF documents, graphics, brand assets, and the Waymaker Leadership Intelligence Library — is the exclusive intellectual property of Fortune 3R LLC and Adanech Begashaw, protected under applicable United States and international copyright, trademark, and intellectual property laws.

7.1 Prohibited Uses

Subscribers and visitors to fortune3r.com are strictly prohibited from:

• Reproducing, copying, or duplicating any paid or free content in any form without prior written permission from Fortune 3R LLC
• Distributing, sharing, forwarding, or redistributing any paid newsletter issues, PDFs, or library content to non-subscribers
• Publishing, posting, or transmitting any Fortune 3R LLC content on any public or private platform, including social media, blogs, podcasts, or newsletters
• Selling, licensing, sublicensing, or commercially exploiting any Fortune 3R LLC content
• Removing, altering, or obscuring any copyright, trademark, or proprietary notices from any Fortune 3R LLC content
• Using the Waymaker Identity Method, Waymaker Transformation Sequence, 4A Transformer, or any proprietary frameworks in any commercial or educational offering without prior written license from Fortune 3R LLC
• Creating derivative works based on Fortune 3R LLC content without prior written permission

7.2 Permitted Use

Subscribers may access, read, and download paid content for their own personal leadership development and internal professional use only. Brief quotation with full attribution to Fortune 3R LLC and Adanech Begashaw is permitted for non-commercial purposes only, provided that such quotation does not constitute a substantial reproduction of any newsletter issue or framework.

7.3 Enforcement

Fortune 3R LLC actively monitors for unauthorized use and distribution of its content. Violation of these intellectual property terms will result in immediate termination of your subscription without refund and may result in legal action, including claims for copyright infringement, damages, and injunctive relief.

8. User Conduct

By accessing fortune3r.com and its services, you agree to use the platform only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

• Attempt to gain unauthorized access to any part of the platform or another user's account
• Interfere with or disrupt the integrity or performance of the platform
• Use any automated means to access or collect data from the platform without written permission
• Impersonate Fortune 3R LLC, Adanech Begashaw, or any other person or entity

9. Disclaimer of Warranties

The services provided by Fortune 3R LLC are offered on an 'as is' and 'as available' basis without warranties of any kind, either express or implied. Fortune 3R LLC does not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the platform is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Fortune 3R LLC and Adanech Begashaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the platform, even if Fortune 3R LLC has been advised of the possibility of such damages. Fortune 3R LLC's total liability to you for any claim arising from these Terms shall not exceed the total subscription fees paid by you in the three (3) months preceding the claim.

11. Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, United States of America, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be resolved exclusively in the state or federal courts located in the State of Georgia.

12. Changes to These Terms

Fortune 3R LLC reserves the right to update or modify these Terms & Conditions at any time. We will notify active subscribers of material changes via email to the address associated with their account no less than fourteen (14) days before changes take effect. Your continued use of the platform after such notice constitutes your acceptance of the updated Terms.
